These Terms of Service govern your use of the Emynel Luxe Experiences website and any enquiry, itinerary design, booking coordination, or related service provided by Emynel Luxe Experiences. By accessing the website or engaging our services, you agree to be bound by these Terms.
1. About our role
Emynel Luxe Experiences curates, coordinates, and manages luxury travel arrangements in Kenya and related destinations. Depending on the journey, we may act as planner, coordinator, intermediary, or booking facilitator with carefully selected third-party suppliers including lodges, transport providers, guides, activity operators, and service partners.
2. Website use
You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others, interfere with the operation of the website, or compromise its security. We may suspend access or take protective action if we reasonably believe the website is being misused.
3. Enquiries and itinerary proposals
Any itinerary, quotation, or planning proposal provided before booking confirmation is informational and subject to availability, supplier confirmation, routing feasibility, and price changes. No reservation is confirmed until payment, supplier acceptance where required, and written confirmation from us or the relevant supplier.
4. Pricing and availability
Quoted rates may change before confirmation due to exchange fluctuations, supplier price changes, tax or fee adjustments, park fee revisions, seasonal changes, and availability constraints. We will make reasonable efforts to advise you promptly of any material change affecting your proposed journey.
5. Booking confirmation
A booking is considered confirmed only after the required deposit or full payment has been received, the relevant services have been accepted or secured, and confirmation has been issued. Different components of a journey may be subject to different supplier conditions, including separate payment, amendment, or cancellation terms.
6. Payments
Payment schedules, deposit requirements, and final balance deadlines will be communicated during the booking process. If payment is not received by the stated deadline, we may release reservations, revise the itinerary, or treat the booking as cancelled, subject to applicable charges.
7. Supplier terms
Hotels, camps, airlines, transport providers, guides, and activity operators may impose their own terms, conditions, safety rules, luggage limits, health requirements, cancellation penalties, and liability exclusions. By confirming services, you agree to comply with the terms of the relevant supplier in addition to these Terms.
8. Changes requested by the guest
If you request changes after itinerary confirmation, we will try to accommodate them, but availability, supplier approval, and additional charges may apply. Some changes may require full repricing or cancellation and rebooking of part or all of the itinerary.
9. Changes outside our control
Travel arrangements may be affected by weather, wildlife movement, road or air access restrictions, conservation rules, civil disruption, supplier operational changes, public authority requirements, health restrictions, or other events beyond our reasonable control. We may make substitutions or operational adjustments where reasonably necessary to preserve the integrity of the journey.
10. Cancellations and refunds
Cancellation terms depend on the timing of cancellation and the conditions imposed by the relevant suppliers. Deposits may be non-refundable, and certain high-demand properties or peak-season services may carry strict penalties. Any refund that is due will usually be limited to sums recovered from suppliers after deduction of any non-recoverable costs, bank charges, and service fees where applicable.
11. Travel documents and guest responsibilities
You are responsible for ensuring that all travellers hold valid passports, visas, health documents, insurance, and any other documents required for the journey. You are also responsible for reviewing itinerary details upon receipt and notifying us promptly of any inaccuracy.
12. Health, safety, and insurance
Travel in safari and remote environments involves inherent risks, including weather, wildlife, road conditions, flight variability, and physical activity. Comprehensive travel insurance is strongly recommended and may be required for some arrangements. You are responsible for determining whether the journey is suitable for your health, fitness, and personal circumstances.
13. Limitation of liability
To the fullest extent permitted by applicable law, Emynel Luxe Experiences will not be liable for indirect, incidental, special, consequential, or punitive losses, or for loss arising from acts or omissions of third-party suppliers, events beyond our reasonable control, guest non-compliance, or inaccurate information supplied by the guest. Where liability cannot be excluded, it will be limited to the amount actually paid to us for the affected service component, except where a different limitation is required by law.
14. Intellectual property
All content on this website, including text, imagery, branding, graphics, and structure, belongs to Emynel Luxe Experiences or is used with permission. You may not reproduce, distribute, modify, or commercially exploit website content without prior written consent.
15. Privacy
Your use of the website and our services is also subject to our Privacy Policy, which explains how we collect, use, and protect personal information.
16. Governing law
